    These Platform Terms & Conditions (“Terms”) are a legally binding agreement between Maa Nest (“Maa Nest”, “we”, “us”, “our”) and everyone who uses our platform — parents, guardians, family members, caregivers, and visitors (“you”).

    By accessing, registering, verifying your identity, booking care, onboarding as a caregiver, or otherwise using Maa Nest, you confirm that you have read, understood, and agree to these Terms.

    1. Who Can Use Maa Nest

    To use Maa Nest, you must:

    • Be at least 18 years old
    • Be legally able to enter into a binding agreement
    • Provide accurate information
    • Comply with applicable laws and use the platform only for lawful purposes

    We may approve, reject, suspend, or terminate accounts at our discretion.

    2. What Maa Nest Is

    Maa Nest is a technology platform that connects parents with independent caregivers. We facilitate bookings, payments, verification, communication, and operational support.

    Maa Nest is NOT a childcare institution, hospital, medical provider, staffing or placement agency, or an employer of caregivers. Caregivers are independent service providers.

    2.1 Service Area Limitation

    Maa Nest services are available only in the cities and locations where we officially operate. Availability may vary depending on operational coverage, caregiver availability, verification status, demand, and other operational constraints.

    2.2 Beta & Experimental Features

    From time to time we may introduce beta, pilot, experimental, AI-powered, or early-access features. These are provided on an “as available” basis and may be modified, suspended, or discontinued at our sole discretion without prior notice.

    3. Women-Only Caregiver Model

    Maa Nest currently operates as a women-only caregiver platform — only eligible women may register as caregivers. This is part of our operational model, childcare philosophy, and safety framework.

    4. Your Account

    You may register using mobile OTP, Google Sign-In, or other approved methods. You are responsible for:

    • Keeping your account secure and protecting your credentials
    • Keeping your information up to date
    • All activity that takes place under your account

    5. Verification

    We may require mobile verification, DigiLocker and KYC checks, identity and educational verification, face verification, and re-verification. Not completing verification may limit your access to features. We may reject or revoke verification at our discretion.

    6. Acceptable Use

    You must not:

    • Submit false information or forged documents, or misrepresent your identity
    • Bypass the platform or arrange care off-platform
    • Abuse other users or engage in fraud
    • Manipulate ratings or create duplicate accounts
    • Interfere with platform operations

    Violations may lead to suspension, permanent bans, booking cancellation, or legal action.

    7. Child Safety

    Child safety is our highest priority. You must:

    • Put children’s wellbeing first
    • Behave responsibly
    • Report concerns promptly
    • Follow our disclosed safety practices

    Any conduct that endangers a child may result in immediate account action.

    8. Caregivers Are Independent

    Caregivers are independent service providers. These Terms do not create an employment, partnership, agency, or joint-venture relationship. Caregivers are solely responsible for their taxes, insurance, regulatory obligations, conduct, and the services they provide.

    Maa Nest does not guarantee earnings, schedules, bookings, or employment benefits.

    9. Payments

    All payments must go through Maa Nest. You must not use cash, direct UPI arrangements, or otherwise bypass billing or conduct private transactions. Off-platform payments may void the protections Maa Nest offers.

    10. No Off-Platform Hiring

    You agree not to privately engage caregivers introduced through Maa Nest outside the platform — during active use and for 6 months after your last booking. Violations may lead to suspension, permanent bans, recovery actions, or penalties.

    11. Privacy

    How we collect, use, store, and share information is governed by our Privacy Policy, which you agree to when using Maa Nest.

    12. Safety Standards

    You agree to follow Maa Nest’s Safety Standards. We may investigate misconduct, fraud, safety concerns, abuse reports, and policy violations.

    13. Community Standards

    You must follow our Community Guidelines. We may remove content or restrict access for violations.

    14. Bookings

    Bookings depend on availability, verification, acceptance, and operational constraints. For operational or safety reasons, Maa Nest may:

    • Reassign bookings
    • Reschedule sessions
    • Cancel bookings
    • Restrict services

    15. Emergencies

    In an emergency, we may share information with emergency contacts, hospitals, authorities, and emergency responders where reasonably necessary. Parents remain responsible for medical decisions, treatment costs, and hospital expenses.

    16. Intellectual Property

    All platform materials — including logos, branding, designs, text, features, software, and content — belong exclusively to Maa Nest. You may not reproduce, copy, modify, distribute, or commercialise them without authorisation.

    16.1 Scope of Protected Materials

    The materials protected under Section 16 include, without limitation:

    • The Maa Nest application and website
    • User interface, designs, graphics, icons, and illustrations
    • Logos, trademarks, and branding
    • Algorithms, matching logic, and databases
    • Software, source code, and content
    • All related intellectual property

    None of it may be copied, reproduced, reverse engineered, modified, distributed, commercialised, or otherwise used without our prior written permission.

    17. Reviews & Ratings

    You may leave reviews based on genuine experiences. Reviews must be truthful and respectful and must avoid defamation or threats. We may remove content that violates our policies.

    17.1 False Complaints & False Reports

    You must not knowingly submit false complaints, fabricated evidence, malicious reports, misleading statements, or fraudulent allegations against another user or against Maa Nest.

    We may investigate any complaint, and may suspend, terminate, or permanently remove users who intentionally submit false or misleading reports. We may also pursue recovery of losses or other legal remedies where applicable law permits.

    18. Platform Monitoring

    We may monitor usage behaviour, communication, device activity, fraud indicators, safety complaints, and circumvention attempts — for security, compliance, child safety, fraud prevention, and operational integrity.

    18.1 Digital Evidence & Investigation Rights

    When investigating a dispute, fraud, a policy violation, a chargeback, a safety incident, or a legal matter, we may rely on the records our systems generate, including:

    • Booking records and timestamps
    • Platform communications and support conversations
    • Payment records
    • Verification logs
    • Device information
    • Location information, where available
    • Other system-generated records

    19. Suspension & Termination

    We may suspend or terminate accounts without prior notice for:

    • Fraud, abuse, or harassment
    • Child-safety risks
    • Policy violations or illegal activity
    • Fake verification or off-platform arrangements

    Maa Nest retains sole discretion over account actions.

    19.1 Temporary Suspension During an Investigation

    While a safety, fraud, payment, regulatory, legal, or policy investigation is ongoing, we may temporarily suspend accounts, bookings, payouts, or platform access, and that suspension may remain in place until the investigation is complete.

    A temporary suspension of this kind is a precaution. It does not imply guilt or liability on the part of the user concerned.

    20. No Safety Guarantee

    While we implement safety measures, verification systems, and operational safeguards, we cannot guarantee compatibility, character, future conduct, continuous availability, or the elimination of all risk. You must use reasonable judgement and precautions.

    20.1 No Childcare Outcome Guarantee

    Maa Nest facilitates access to childcare, but alongside the limits in Section 20 we do not guarantee any particular outcome for any child, including:

    • Developmental or educational outcomes
    • Emotional or behavioural outcomes
    • Feeding or sleeping outcomes
    • Health or parenting outcomes
    • Any other childcare outcome

    Decisions about a child’s care remain the parent’s responsibility.

    21. Limitation of Liability

    Maa Nest is not liable for:

    • Third-party, parent, or caregiver behaviour
    • Household incidents or medical outcomes
    • Emotional distress, indirect damages, or lost opportunities
    • Off-platform arrangements

    Our maximum liability will not exceed the amount you actually paid to Maa Nest for the affected booking.

    21.1 Property Loss & Investigation

    Except to the extent applicable law requires otherwise, Maa Nest is not responsible for disputes involving alleged theft, missing property, or property damage.

    Where such an allegation arises, we may review the available evidence, booking records, communications, verification information, and other relevant material before deciding whether any platform action is appropriate.

    22. Indemnification

    You agree to indemnify and hold harmless Maa Nest, its founders, employees, affiliates, officers, and partners from claims arising out of your misconduct, policy violations, fraud, false declarations, negligence, off-platform interactions, or breach of these Terms.

    23. Events Beyond Our Control

    Maa Nest is not liable for delays or failures caused by events beyond our reasonable control, such as natural disasters, internet or power outages, government restrictions, epidemics, public emergencies, or strikes.

    23.1 Third-Party Services

    Maa Nest depends on third-party providers to operate, including:

    • Payment gateways
    • Verification providers, such as DigiLocker and KYC partners
    • SMS and OTP providers
    • Mapping services
    • Cloud infrastructure
    • Analytics providers
    • Other technology partners

    We are not responsible for delays, outages, inaccuracies, interruptions, or failures caused by those services where they are beyond our reasonable control.

    24. Changes to These Terms

    We may update these Terms from time to time. Updated versions take effect when published, and continued use of Maa Nest means you accept the revised Terms.

    25. Governing Law

    These Terms are governed by the laws of India, and any disputes fall under the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.

    26. Dispute Resolution

    We will first try to resolve disputes through good-faith discussion. If unresolved, disputes may be referred to arbitration in Bengaluru, Karnataka under applicable Indian law, and the arbitrator’s decision will be final and binding.

    27. Electronic Consent

    By registering, booking, verifying your identity, onboarding, or continuing to use Maa Nest, you agree that your electronic acceptance is legally binding and that electronic records have the same effect as physical signatures, to the extent permitted by law.

    28. Severability & Entire Agreement

    If any part of these Terms is found invalid, the rest remain in effect. These Terms — together with our Privacy Policy, Parent and Caregiver Terms, Refund Policy, Community Guidelines, and Safety Standards — form the complete agreement governing your use of Maa Nest.
